Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you and Erin Claire Jones, LLC (“5Types,” “we,” “us”) governing your use of the 5Types website, applications, and services (the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

You must be at least 16 years old to use the Service. By using 5Types, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.

You are responsible for the information you provide and for activity that occurs under your account. Keep your sign-in credentials secure, provide accurate information, and notify us promptly of any unauthorized use. You may close your account at any time from Settings.

5Types lets you generate a personality and Human Design chart from your birth details, explore that chart, and converse with an AI assistant about it. We may add, change, or remove features over time, and we may set limits on use to keep the Service running reliably for everyone.

5Types is provided for personal interest, entertainment, and self-reflection. Human Design and related personality frameworks are not scientifically validated, and the charts, readings, and assistant responses you receive are not statements of fact.

The Service does not provide medical, mental-health, psychological, legal, financial, or other professional advice, and is not a substitute for consultation with a qualified professional. You are solely responsible for any decisions you make, and you should not rely on the Service for important life, health, or financial choices. If you are experiencing a crisis or need professional help, contact a qualified provider or your local emergency services.

5Types offers a free tier and a paid “Plus” subscription at the then-current price shown at checkout. Each tier includes a monthly allowance of credits that powers the assistant; the allowance resets each billing cycle and does not roll over. You may also purchase additional “extra usage” credits, which do not expire.

• Payments are processed by our third-party payment processor. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.
• Subscriptions renew automatically at the end of each billing period unless you cancel beforehand. You can cancel anytime from Settings and will keep paid access until the end of the period you have already paid for.
• Except where required by law, payments and purchased credits are non-refundable, and credits have no cash value.
• We may change prices or plan features. We will give notice of material changes, and price changes take effect at your next billing period.

When using the Service, you agree not to:

• Break the law or infringe the rights of others.
• Submit another person’s personal or birth information unless you are permitted to do so.
• Attempt to access accounts or data that are not yours, or disrupt or probe the Service’s security.
• Scrape, copy, or harvest content, or reverse engineer the Service, except as permitted by law.
• Resell or commercially exploit the Service without our permission, or use it to build a competing product.
• Misuse the assistant to generate unlawful, harmful, or abusive content.

You retain ownership of the information and content you submit, such as your birth details, charts, and messages. You grant us a limited license to host, process, and use that content as needed to operate and improve the Service and to provide it to you, including sending the necessary context to our AI providers to generate responses.

If you add information about another person, you confirm that you are entitled to provide it and to have it processed by the Service.

The Service, including its software, design, text, and encyclopedia content, is owned by us or our licensors and is protected by intellectual-property laws. We grant you a non-exclusive, non-transferable, revocable license to use the Service for your own personal and professional purposes, subject to these Terms.

Responses from the assistant are generated by AI and may be inaccurate, incomplete, or inconsistent. They do not represent our opinion or professional advice. Verify anything important before relying on it, and use your own judgment. Subject to these Terms, you may use the responses you generate for your own personal and professional purposes.

The Service relies on third-party providers (for example, authentication, payments, AI models, and email) and may link to third-party sites. We are not responsible for third-party services, and your use of them may be governed by their own terms and policies.

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any content or result will be accurate or reliable.

To the fullest extent permitted by law, 5Types and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or one hundred U.S. dollars (US$100). Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

You agree to indemnify and hold harmless 5Types and its operators from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your content, or your violation of these Terms or the rights of others.

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Provisions that by their nature should survive termination — including ownership, disclaimers, limitations of liability, and indemnification — will survive.

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, notify you. Your continued use of the Service after an update means you accept the revised Terms.

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. Before filing a claim, you agree to first contact us at hello@5types.com so we can try to resolve the matter informally. Any dispute that cannot be resolved informally will be subject to the exclusive jurisdiction of the state and federal courts located in New York, and you consent to venue there.
